Welfare checklist

a. The ascertainable wishes and feelings of the children, taking into account the childrens age and understanding.

b. The childrens physical, emotional and educational needs.

c. The likely effect on the children of any changes and circumstances.

d. The childrens age, sex and relevant background characteristics.

e. Any harm the children have suffered or at risk of suffering.

f. How capable each parent or any other person in relation to whom the court considers to be relevant is of meeting the childrens needs.

g. The range of powers available to the court under this Act in the proceedings in question.

Irwin Mitchell do not follow the Protocol involving ancillary relief proceedings and adopt the approach of provocation, hostile correspondence and unsrupulous intimidation. Do not chhose them if you want a conciliatory out of court settlement. They are out to make as much money from the case as possible
