If the business is a large asset it may be necessary for an expert valuation to be undertaken by an independent accountant. The fees incurred for this service will usually be shared between you. The report can then be relied upon by your legal advisers in any negotiations or by the Court. A claim may not be made directly against the business or its assets as this would have a detrimental effect on the future viability of the business. The income generated and fixed assets of the business will, however, assist in determining the earning capacity and future resources of the spouse involved in the business and consequently be a factor in determining the level of spousal and child maintenance and an appropriate division of any other capital assets of the marriage, such as the matrimonial home.
