The decision to bring a relationship to an end is an extremely difficult one. Whilst the concept of the family unit may have changed considerably over recent years, the needs of individuals whose relationships break down remain the same. The breakdown of a relationship gives rise to a variety of legal problems as well as being very distressing to those involved.
If two people choose to cohabit, rather than marry, a judge does not have the same powers to divide income, capital, property and pension. However, either party could argue an interest or right by contribution to an asset that is owned by the other, such as a house. Property and other assets may also have been bought in joint names during the relationship.
A cohabitation agreement can set out what each party intends to happen if the relationship ends, both to assets that existed before the relationship started and any accumulated during its course. Such an agreement legally binds the parties involved and is a step we would recommend to anyone considering cohabitation.
With careful planning, taxation can be minimised as ownership of a business passes between members of a family.
For example, business assets can often be gifted or passed on death free of inheritance tax. At present, a 100% deduction in value is allowed for tax purposes in respect of shares owned in most unquoted trading companies and partnership interests. The exceptions are where the business wholly or mainly deals in investments or property. |

From April 2002, a much simpler version of the Child Support Agency formula comes into effect whereby, put simply and subject to various exceptions too numerous to go into here, the parent with whom the children live receives 15% of the other parent's net income for one child, 20% for two, and 25% for three or more. The system will start with all new cases from that date, although older cases will begin to be re-assessed under the new rules in due course, some have said as early as July 2002.
The role of the courts, which up until now have retained some jurisdiction in assessing child maintenance, will be further restricted and, in essence, the courts will only have a role in the following circumstances:
In the case of step-parents.
Where parents are resident outside the UK.
Where children are not in full-time education.
Where the parents, although separated in the sense that they lead separate lives, remain under the same roof (usually for financial reasons).
For education, cost of disability, and top-up maintenance where incomes are very high.
The courts also retain jurisdiction if both parties agree that they should do so.
The new Child Support Agency rules have been generally welcomed as providing certainty and an easier method of calculation which is transparent to both parents and, in turn, this should mean that assessments and the other work of the Child Support Agency, particularly as to enforcement, should be that much quicker. The courts, who up until 1991 determined child maintenance, will find their role further decreased although not excluded altogether.
