1. Somerset, Dorset, Devon, Solicitors, Porter Dodson
On the break up of a family parents normally consider the effect on any children as the most important aspect. The law shares that view.

Before a divorce can be granted the Court has to consider the welfare of any children.

Normally the Court will not interfere in the arrangements made by the parents unless asked to do so.

After divorce both parents retain 'parental responsibility' which means they remain joint responsibly for their children.

Unmarried fathers may not automatically have 'parental responsibility'. We can advise you about this.

Agreements about money, houses, and property can be most difficult to settle.

The aspects to consider are:
Who keeps the home
The division of any capital and savings
Maintenance for the children
Maintenance from one spouse to the other
Pensions

Wherever possible it is better to reach agreement rather than go to Court. No two cases are the some.

Porter Dodson was formed in May 1997 by the merger of two West Country practices - Dodson Harding of Taunton, Bridgwater and Wellington and Porter Bartlett & Mayo of Yeovil and Sherborne. In May 1999 the firm was further expanded by its merger with the Dorchester based practice Lock, Reed & Lock. These mergers of firms of similar philosophy and with over 200 years' experience makes Porter Dodson one of the largest legal practices in the South West of England, offering clients a still greater level of experience and specialisation over a wide range of legal services.

Key among Porter Dodson's objectives is the desire to provide both individual and corporate clients with a quality personal service, which is second to none. The firm is committed to total client care and providing first class legal advice. Its extensive investment in Information Technology enables each office within the Porter Dodson group to offer a complete legal service with immediate access to the whole firm's network of highly trained specialists.

6. Taunton Solicitors: Broomhead & Saul
We can provide advice on:
Separation and Divorce
Mediation
Welfare of Children
Adoption and Paternity issues.

The Children Act 1989 was brought in to try and protect children more effectively.

If you or your partner cannot decide what is best for your children then the court will make the decision for you. The court?s only concern is what is best for the children. If you do not know where to turn we can help.

You can apply to the court for them to decide where the children should live. This is called a "Residence Order".

It is possible to apply for a "Joint Residence Order", but the courts do not usually like to make such orders especially if it will mean the child will have to divide their time between two homes. Your solicitor can advise you if a Joint Residence Order is appropriate.

If you have a Residence Order you are allowed to take the children out of the country for less than 1 month at a time without your partner?s consent.

If you want to take the children to live abroad permanently then your partner may have to consent to this or you will have to get permission from the court.

7. Alletsons Solicitors Bridgwater
Family mediation is a process of negotiation with your husband or wife about the practical effect of separation. A mediator will sit around a table with you and your husband or wife to help reach an agreement. This can be useful because the breakdown of a relationship can make negotiation difficult or painful. A mediator is trained to keep discussions going forward and to minimise time spent arguing about the past.

If you would like to know more about mediation or about details of the local mediation service then please do not hesitate to ask. I have enclosed a leaflet called ?Talk? which may help initially.

The court is under specific duty when there is an ancillary relief application to consider whether it would be appropriate to end one of the parties financial obligations to the other. Therefore when making a maintenance order the court is under duty to consider whether the orders should be made for a fixed term only or indefinitely. The court is also obliged to consider whether maintenance orders are appropriate at all since this means that there will be a continuing financial relationship between the parties.

9. Withy King Solicitors: Bath, Swindon, Trowbridge and Marlborough
Divorce or separation often has life changing consequences for those involved. We realise that the process can be one of the most difficult and upsetting events of your life. Our objective is to give honest, straightforward advice in a sensitive and understandable way.

Withy King is one of the South West's leading family law practices. Our team comprises expert, sympathetic lawyers who can guide you through difficult issues: divorce, financial arrangements, issues surrounding children, and domestic violence.

We also have extensive experience of dealing with complex issues arising out of a divorce or separation, relating to property, finance, pensions and company ownership. We provide practical solutions that enable separating couples to divide their assets sensibly and fairly.

One of our lawyers has been named as one of the eight best divorce lawyers in Britain , four are accredited Resolution specialists (formerly the Solicitors Family Law Association) in recognition of their experience and expertise, four are qualified Collaborative law practitioners and three are members of the Law Society's specialist Children Panel.

We have a Legal Services Commission Family Specialist Quality Mark, which is an objective seal of approval recognising the quality of advice given to clients.

We encourage clients to resolve issues amicably, recognising that litigation can be time consuming, stressful and, sometimes, counter-productive. However, if agreement is not possible, we will not hesitate to pursue your case vigorously through the courts, to achieve the best result we can for you.

While the process of obtaining a divorce is not complex, there are many ancillary issues that require careful analysis. Our experienced team can provide this for you with the objective of ensuring that you and your family have long-term security.

We believe that we provide our clients with unrivalled expertise in the law and that we communicate clear advice in a compassionate manner.

While the process of obtaining a divorce is generally straightforward, it is important to obtain specialist advice before commencing proceedings, to ensure that the consequences of such a course of action are clearly understood. Amongst other things, a divorce affects your status in that you will no longer be entitled to any benefits under the terms of your spouse's Will or any relevant pension provision.

The Court will also want to be satisfied about any arrangements that are proposed in relation to the children of the family.
