|
Blake Lapthorn Linnell has one of the largest specialist Family Law and Children teams in the South. We are able to provide clear and objective advice and sensitive help with all problems in this area of the law. The team have a depth of expertise and experience in divorce, separation, the financial consequences of relationship breakdown, cohabitation, pre-marital agreements, and children proceedings.
Our aim is to provide expert legal advice and representation to enable clients to be sure of their rights and help them reach a fair settlement. Our professional, yet personal, service is tailored to meet the aims of the individual and provide peace of mind and sensible pro-active solutions to the range of family and children problems that can arise. Our experience enables us to minimise conflict and hostility wherever possible and to work with clients to obtain the best possible outcome.
The complexity of issues in family matters requires specialist and discrete guidance. This often includes advice on the international aspects of disputes, commercial issues and business concerns.
All of the team are members of the Solicitors Family Law Association, two are member of the Law Society's Family Law Panel, and two are members of the Solicitors Family Law Association panel of experts. This panel membership reflects their particular expertise in these areas, above and beyond the normal legal qualification.
We have good contacts with a range of professionals and can help put you in touch with other professionals and advice agencies where appropriate for specialist help such as pensions and tax advice.
We take an approach which is designed to assist parties in coming to a suitable outcome, and utilise the Solicitors Family Law Association Code of Practice in appropriate cases.
Obtaining a divorce can be straightforward if both parties agree that the marriage is over. Difficulties arise in resolving how and when to separate, where to live, and what arrangements to make for children and finances.
Blake Lapthorn Linnell offers a constructive approach to help progress things as quickly as possible. We will be happy to discuss anything that is unclear or answer any further questions you may have.
Anyone who has been married for over a year, providing one of the couple has their permanent home, or has been resident at least a year prior to the divorce petition is started, in England or Wales. It doesn't matter where you were married.
The divorce takes approximately 4-6 months although the Decree Absolute is often not obtained until the finances are resolved. This may be much later. |

| 12. UK Solicitor, Divorce Settlement
|
With statistics of 1 in 3 marriages ending in divorce and many unmarried people living together, the end of a relationship now entails far more than a simple parting and a solicitor is often involved.
All Herrington & Carmichael matrimonial lawyers are highly experienced professionals, members of the Solicitors Family Law Association, and familiar with the emotions and conflict divorce can bring. They help our clients through the legal complexities involved in splitting assets, making provision for the children and finalising the divorce.
In appropriate cases, the use of mediation is recommended as a means of achieving an amicable settlement, and can also help speed up the process and cut costs.
Benefits can be
Better solutions reached by the parties themselves.
Powerful messages to the children of their parents working together on their behalf.
Total confidentiality and impartiality.
Quicker solutions at less personal and financial.
Protects legal rights but most mediations end in agreement.
Resolve any other financial issues.
These decisions can then be passed directly to the Court as part of the final divorce settlement. Resolution of differences made in these circumstances can not only speed up the process, but reduce costs. They are also very much tailored to individual needs, with each partner having an equal opportunity to voice their opinions and desires. The non-confrontational atmosphere reduces conflict and aids communication, thus making an amicable agreement far more likely.
One of the first solicitors to offer mediation in the UK.
Herrington & Carmichael were one of the first solicitors in the UK to offer this unique scheme and now have many years of experience in resolving the conflicts of divorce and separation.
Highly experienced mediator Richard Whittington is a fully trained mediator who has been involved in family law since he qualified in 1978. He was Chairman of the Surrey Heath Domestic Violence Forum and a member of the Family Mediators Association and The U.K. College of Mediators. He is also a member of the Family Law Panel. His extensive experience of handling mediation puts him in an ideal position to remove conflict from the negotiations.
The speed with which the law changes today can be breathtaking. That's why it is so important to take good legal advice. Herrington & Carmichael has been offering high quality legal advice and representation to clients - in clear, jargon-free language - for well over a century. Although we strongly believe in the traditional values of excellent service and value for money, our clients appreciate our innovative, proactive and friendly approach to all their legal concerns. |
