In November 2004 the Civil Partnerships Bill was passed by Parliament. The first civil partnership will be capable of being registered by 21 December 2005. For same sex couples, this is the equivalent of the Velvet Revolution. Same sex couples will have to all intents and purposes, the same rights and obligations as heterosexual married couples.
Once registered, a civil partnership will only be capable of dissolution, in the same way that a heterosexual marriage is dissolved; namely through a process which is, as near as makes no odds, to divorce. There will be the same financial implications on the dissolution of a partnership, as there is on a heterosexual divorce. On the face of it, civil partners can claim maintenance, capital settlement and provision under the Inheritance Act 1975.

A cohabitation agreement can set out what each party intends to happen if the relationship ends, both to assets that existed before the relationship started and any accumulated during its course. Such an agreement legally binds the parties involved and is a step we would recommend to anyone considering cohabitation.
With careful planning, taxation can be minimised as ownership of a business passes between members of a family.
For example, business assets can often be gifted or passed on death free of inheritance tax. At present, a 100% deduction in value is allowed for tax purposes in respect of shares owned in most unquoted trading companies and partnership interests. The exceptions are where the business wholly or mainly deals in investments or property.
