The decision to separate is a private matter. You and your partner, whether married or un-married, are free to decide and agree how to resolve the issues that arise on separation, such as the children, finances etc. However, if you want any arrangement to be legally binding and enforceable, then you must take separate (independent) legal advice.

If you have been unable to reach an agreement on the issues in private, another method of trying to resolve the dispute is through mediation.

Mediation aims to assist communication between those involved and facilitate agreement. The issues to be discussed in mediation are agreed between the couple but can include whether to divorce, the children and the financial situation.

The Mediator does not make decisions nor give legal advice. Any agreement reached is not legally binding and at the end of the process, you will be referred to your own solicitors for advice and to formalise the agreement.
